CONTRACT

TERMS OF AGREEMENT

Deposits:

• A minimum deposit of $50.00 is required for an event that does not require meeting with the Client and planning the event. This deposit and signed Contract will be due within 14 days of the date of the event to bind terms.

• A minimum deposit of $75.00 is required for any event that requires meeting with the client, planning and/or rehearsals such as wedding ceremonies and receptions. This deposit and signed Contract will be due at the first Client meeting to bind terms.

Any deposit received will go toward the total bill and the balance of the amount agreed upon will be due at time of DJ arrival before setup. The deposit is non refundable.

 Make check(s) payable to ‘STEVEN SIMMONS’.

After all of the information needed is gathered from the Client about the Event and is able to accept due to scheduling, “SS” DJ Service will issue a “Firm Quote” up front to the Client by Verbal, Text, or Email to make sure the Client agrees to price before moving forward with “SS” DJ Service performing at the Client’s Event. This “Firm Quote” will not increase unless the Event time lengthens after the “Firm Quote” was issued to the Client.

Parties entering into this contract are permanently bound to fulfill the obligations by this agreement unless one or more of the following conditions apply:

• Both parties mutually agree to leave the agreement and its responsibilities.

• The event described herein is completely canceled on the date agreed upon.

“SS” DJ Service shall not be held liable for any action or damage arising from or in connection with any individuals not directly affiliated with “SS” DJ Service. Furthermore, the customer contracting with “SS” DJ Service agrees to assume full responsibility for any / all damages to the property of “SS” DJ Service either caused by themselves, their guests, or any other party in attendance whether invited or not.“SS” DJ Service reserves the right to deny guest access to the Sound system, Karaoke equipment, or Performance area.

For indoor performances, it is understood that if this is a "Rain or Shine" event, “SS” DJ Service’s compensation is in no way affected by inclement weather.

For outdoor performances, the customer shall provide overhead shelter for setup area. The DJ reserves the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to him, the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. The DJ's compensation will not be affected by such cancellation.

The customer shall provide “SS” DJ Service with safe and appropriate working conditions. This includes a 6-foot by 6-foot area for setup and space for setting up speakers. “SS” DJ Service requires a minimum of one 15-20-amp circuit outlet from a reliable power source within 80 feet (along the wall) of the set-up area. This circuit must be free of all other connected loads.

 Purchaser shall provide Address of the Event Location. Purchaser is responsible for paying any charges imposed by the venue.

 “SS” DJ Service shall attempt to play Purchaser's and Purchaser's guests' music requests but shall not be held responsible if certain selections are unavailable. “SS” DJ Service will make an extra effort to have music requests available if they are received in writing, text messaged, or emailed at least one week prior to the engagement.

This agreement guarantees that “SS DJ Service will be ready to perform at the start time of the Event; however,   “SS” DJ Service requests to be permitted sixty (60) minutes before the Event and forty five (45) minutes after the Event for setup and breakdown.

By executing this contract as Purchaser, the person executing said contract, either individually, or as an agent or representative, represents and warrants that he or she is eighteen (18) years of age, and further, if executing said contract as agent or representative, that he or she has the authority to enter into this agreement; therefore, the person executing said contract personally accepts and assumes full responsibility and liability under the terms of this contract.

This contract contains the entire agreement between the parties and no statement, promises, or inducement made by any party, agent or representative, which are not contained in this written contract shall be legally binding.

The laws of the State of Virginia shall govern this agreement. In the event of suit involving or relating to this agreement, Purchaser agrees to defend, indemnify, assume liability for and hold “SS” DJ Service harmless from any claims, damages, losses and expenses by or to any person, regardless of the basis, which pertains directly or indirectly to “SS” DJ Service’s performance. In the event that a civil action arises in an effort to enforce any provision of this agreement, the losing party shall pay the attorney's fee and court costs of the prevailing party.
